In many cases, differences can be resolved without litigation. When appropriate, we actively pursue alternative dispute resolution methods, including negotiation, mediation and collaborative practice, while keeping the client’s goals and objectives as our principal concern.
In mediation, a neutral, third party mediator is hired to help facilitate settlement negotiations. The mediator has no authority to force settlement. Mediation is confidential, and the mediator cannot be compelled to testify at trial. All final decisions are made by the parties, giving them ultimate control over the outcome of their disputes.
Collaborative law is similar to mediation in terms of confidentiality and empowerment of the parties. In the collaborative law process, the parties and their attorneys work with a team of neutral experts to reach an outcome that is acceptable to both parties. The neutral experts typically include a communications facilitator, (who also helps the parties create a parenting plan), a financial expert, and occasionally a child specialist to represent the interests of the children. Using interest-based negotiation techniques, the "collaborative team" works together to help the parties resolve their issues in a constructive manner to reach a mutually acceptable agreement.
